During Lawsuit Abuse Awareness Week, Rickie Guillory, owner of Guillory Petroleum Transport, joined Brian Haldane on Mornings With Brian Haldane to discuss how rising insurance costs and costly litigation affect Louisiana businesses.
How Lawsuits Affect Trucking Companies
Guillory, who has operated his trucking business with a partner for more than 20 years, oversees a fleet of approximately 50 trucks and 70 trailers. His company transports fuel and lubricants throughout Louisiana and neighboring states, as well as across the country.
He said rising insurance premiums have placed significant pressure on his business. According to Guillory, his insurance costs increased by approximately $500,000 over three years, despite the company not experiencing a corresponding increase in accidents.
He argued that even minor collisions can trigger expensive lawsuits. Guillory cited an incident involving a truck traveling about 7.5 miles per hour that caused approximately $3,000 in damage to a vehicle door. The other party initially sought more than $700,000, leaving the company to negotiate a substantially lower amount.
Calling for Lawsuit Reform
During the interview, Guillory outlined several reforms he believes could help control litigation costs. These include reasonable limits on damages, greater transparency in medical billing, scrutiny of expert witnesses, disclosure of third-party litigation funding and more oversight of attorney advertising.
He argued that these measures could discourage excessive claims and help businesses manage insurance expenses. He also warned that third-party litigation funding can introduce additional financial interests into lawsuits.

Guillory stressed that rising insurance costs affect more than trucking companies. Businesses often pass higher operating expenses on to customers, potentially increasing prices for groceries, fuel, clothing and other everyday necessities.
He also emphasized the human impact on truck drivers, who face the stress of potential accidents and costly legal disputes while trying to support their families.
